TERMS OF USE

These terms of use (hereinafter, "Terms of Use") regulate the access, use and registration of the NTT DATA EMEAL Group (hereinafter, "NTT DATA EMEAL Group" or "Company") that the Company makes available to employees as a technological tool created to publicise volunteering actions and activities among employees and manage their participation in them (hereinafter, the "Portal"). It also serves as a channel for news and communication of experiences related to volunteering actions and activities. 

These Terms of Use together with the Legal Notice, the Privacy Policy and the Cookie Policy together constitute the Policies (collectively, the "Policies") that apply to the access, use and registration of the Portal. 

These Policies are updated periodically and, therefore, the applicable version will be the one published on the Portal at the time of use. Please read these Policies carefully, both before and after, periodically, using the Portal, to keep yourself informed of possible changes. 

By accessing, using and registering on the Portal, as a User, you declare that you have read and accept these Terms of Use and agree to abide by them in full.

1. Who can be a User? How to access the Portal? 

The Portal may only be used by Users who, by virtue of their professional relationship with any of the Company's entities, wish to use it, in accordance with the provisions of this document. An updated list of the companies of the NTT DATA EMEAL Group can be found here . 

The User undertakes to make diligent use of the access codes and to keep them secret, these being of a personal and non-transferable nature in all cases, and shall be responsible for all damages that, where appropriate, may be caused by their inappropriate and/or negligent use. Likewise, in the event of detecting knowledge and/or improper use of the access codes, the User undertakes to immediately notify the Company of the improper knowledge of the same by third parties via the following e-mail address: social.impact@nttdata.com. 

Access to the private area by Users of the Portal is free of charge. Likewise, the User may unsubscribe from the Portal by writing to the following e-mail address: social.impact@nttdata.com. 

2. What functionalities and/or contents does the Portal have?

Users of the Portal will be able to access the functionalities and/or contents that are available at any given time, among others:

  • Access the internal and external "Volunteering" section with information on volunteering actions and activities.
  • Consult the "News" section and the "Experiences" section shared by other Portal Users.
  • Share opinions or comments with other Users of the Portal.
  • Make donations through the "Donations" section.
  • Consult and manage your profile in the "My Zone" section, where you can complete or modify your details, consult the latest participations you have made or the list of opportunities in which, if applicable, you are interested.

3. What are your responsibilities as a Portal User?

Users must respect the rights of other Users, the system and resources as a whole, and comply with applicable laws and regulations. Likewise, Users must avoid activities involving unauthorized access or identity theft, respecting the rights of third parties, as well as software licensing policies, generally avoiding fraudulent uses or any other activity that may hinder the normal operation of the Portal and its use by other Users. Consequently, Users accept:

  • Use the Portal in accordance with the provisions of these Terms of Use and any documents that form part of these Terms of Use.
  • Not to defame, abuse, harass, stalk, threaten or otherwise violate the rights of other Users or persons.
  • Not to remove or attempt to remove any of the security measures adopted and implemented on the Portal.
  • Refrain from any action that may put your User account at risk, and report any incident with the User account, information security or personal data detected on the Portal. 

Any use of the Portal other than as provided for in these Terms of Use is prohibited unless expressly authorized in writing by the Company. 

If as a User you are aware of the existence of prohibited or illegal content, or any content or conduct that may constitute a violation of intellectual and industrial property rights or personal data regulations, please notify the Company immediately at the following e-mail address: social.impact@nttdata.com.

In case of breach of these Terms of Use by Users, the Company shall be entitled, if required by the circumstances of the case, to take appropriate disciplinary and legal actions.

4. Hyperlinks and third-party sites

In case of the Portal having links to other Internet sites (such as LinkedIn, Facebook, Twitter, etc.), the Company shall not exercise any type of control over such sites and content and assumes no liability for the information contained therein. The presence of links on the Portal is for information purposes only and in no case implies a suggestion, invitation or recommendation of the same.

The Portal may be integrated with third-party services to make available content, services or enable functionality within the Portal. These third-party services may have their own terms and conditions of use and privacy policies, and your use of such third-party services shall be governed by and subject to such terms and conditions of use and privacy policies. As a User, you understand and agree that the Company does not endorse and is not responsible or liable for the conduct, features or content of any third-party services or any transactions you may enter into with the provider of such third-party applications, and assumes no liability for any damage or loss caused or alleged to be caused by such third-party content, materials and services.

5. Aviability and Modifications

The Company cannot guarantee a permanent and uninterrupted service of the Portal. Access to the Portal may be interrupted, restricted, delayed or limited in another way for various reasons, including, among other reasons, maintenance work and upgrades carried out to improve the quality, use and content of the Portal. Where reasonably possible, the Company will give prior notice of interruptions to the Portal service. The Company shall not be liable for the lack of availability or continuity of the Portal services for reasons beyond its control and/or caused by network, electronic devices or third-party service errors. Furthermore, in order to improve the Portal, the Company reserves the right, at any time, without prior notice, to modify, extend or temporarily suspend the layout, technical specifications or services. Also, the Company reserves the right to modify, at any time, these Terms of Use and any other terms and conditions.

6. Image Rights and Intellectual and Industrial Property

All the contents of the Portal, including but not limited to texts, images, files, photographs, logos, graphics, brands, icons, combinations of colors or other elements, the structure, design, selection of the layout of the contents, software, links and any other audiovisual or sound content, as well as the graphic design and source code necessary for the operation, access and use of the Portal, are protected by intellectual and industrial property rights, owned by the Company or third parties, and their exploitation rights may not be understood to have been transferred under any circumstances.  

In particular, the reproduction, transformation, distribution, public communication, dissemination and, in general, any other form of exploitation, by any means, of all or part of the content of the Portal, including the design, selection of material and its layout, are strictly prohibited. These actions may only be carried out with the express authorization of the Company or the legitimate owner of the exploitation rights. Decompiling, disassembling, reverse engineering, sublicensing, transmitting by any means, translating or carrying out related work on the computer programs necessary for the use, access or operation of the services and/or contents of the Portal is strictly prohibited. Related to all or a part of the Portal, any act of exploitation other than those described in the previous paragraph is also prohibited. 

The User must refrain from removing, evading or altering any protection device or security system that may be installed on the Portal. The trademarks, trade names or identifying symbols are owned by the Company or third parties. It is understood that the User shall not be attributed any type of right over these trademarks, trade names and/or identifying symbols by accessing the Portal. 

The Company reserves the right to control the use, access, identity of access and, in general, the correct use of the Portal, as well as to implement the necessary measures to maintain control, including the elimination of information, links, news or content uploaded by Users that does not strictly comply with these Terms of Use. As a User you must also refrain from uploading to the Portal any content subject to the rights of third parties without their due authorization.  

If Users upload any photographs to the Portal through the "Experiences" section, Users grant the Company a perpetual, irrevocable, worldwide, non-exclusive license to reproduce, distribute, publish, display, process, adapt and modify the photographs, with the right to transfer them to third parties, in any existing or potential media, including this Portal, websites and any other service or platform of the Company, as well as in their accounts and profiles on social networks (Facebook, Twitter, Instagram, etc.), online reproduction and/or streaming platforms (Youtube, Vimeo, etc.), and any other digital or printed media of the Company or any third party authorized by the Company. 

Users authorize the Company to perpetually and worldwide reproduce and publish their image with the right to transfer it to third parties, in any photographic and/or video format and/or any image fixation media, in any existing or potential media, including this Portal, web pages or social network profiles (Facebook, Twitter, Instagram, etc.), online reproduction and/or streaming platforms (Youtube, Vimeo, etc.), as well as any other media (television, press, etc.) and any other digital or printed media owned by the Company or any third party authorized by the Company. 

In addition, Users warrant that they own all intellectual property rights to the photographs granted to the Company, or, if applicable, have the necessary rights to grant them to the Company. Users shall exclusively assume, totally exonerating the Company and undertaking to hold the Company harmless, any type of liability arising from any claim made by third parties in relation to the use of the photographs, and for any reason whatsoever. Likewise, Users guarantee to have all the image rights of the persons who may appear in the photographs for publication by the Company under the terms described in the Terms of Use, exonerating the Company from any type of liability and claim for the use of their image.

7. Data Protection

In order for the Portal to function, the Company will collect and process your personal information. The fair and lawful processing of your data is very important and deserves to be explained in detail in the Privacy Policy. This Privacy Policy is provided in a separate document accessible from the Portal. 8. Liability

The Company assumes no liability for any errors or omissions within the content of the Portal or other content accessed through the Portal. Nor shall the Company be liable for any damage caused by the use of the Portal, or any other action taken with the information made available on the Portal. 

The information provided on the Portal is not guaranteed in any way, explicit or implicit, and may be modified or updated without prior notice. The content of the Portal and/or the Applications is for informational purposes only. Users are aware and voluntarily accept that the use of any content on the Portal is at their own and sole liability. 

The Company declares that it has implemented all necessary measures, within its capabilities and the possibilities offered by current technology to ensure the functioning of the Portal and to prevent the existence and transmission of viruses or other components harmful to Users. However, the Company makes no warranty as to the suitability or usefulness of the content of the Portal, and accepts no liability for any damage caused, to Users or third parties, by a person in breach of these Terms of Use or as a result of a breach of the Portal's security systems. 

The Company disclaims any liability for opinions or comments of Users expressed on the Portal or information shared by Users on the Portal. Liability for opinions or comments expressed or information shared through the Portal rests solely with the Users who post them. 

The Company reserves the right to deny, suspend, interrupt or terminate access to or use, in whole or in part, of the Portal to Users who violate these Terms of Use for any reason, or any data protection or intellectual property obligations. Furthermore, such Users may be subject to technical intervention (to minimise the impact of the incident) or disciplinary action - depending on the Company's legal relationship with the User - if deemed necessary, including, for example, the removal or blocking of content. In any case, the User shall be liable for damages of any nature that the Company may suffer as a result of a breach of any of the obligations to which the User is subject by these Terms of Use.

9. Applicable law

The use of the Portal and these Terms of Use is governed by the legislation of the country in which the company that owns the Portal its registered office.
